Supreme Court Hears Challenges to Defense of Marriage Act

Today, the Supreme Court listened to oral arguments concerning the constitutionality of the Defense of Marriage Act, the federal law which prevents recognition of same-sex marriages on the federal level. The law as it stands prevents same-sex couples from enjoying many of the same protections under federal law that other married couples receive, including the ability to sponsor a spouse for a visa or eligibility for federal employee benefits for spouses. As supporters of civil rights for all, Beranbaum Menken strongly supports the right of same-sex married couples to be treated like all other married couples. We believe that DOMA unconstitutionally infringes on the right of same-sex couples to equal protection under the law.
